Terms and Conditions of Equipment RentalIntroductionWelcome to our equipment rental service! These Terms and Conditions ("Terms") govern the rental of equipment, including but not limited to excavators, loaders, and other machinery. By renting equipment from us, you agree to these Terms, so please read them carefully. If you do not agree with any part of these Terms, please refrain from renting our equipment. These Terms form a legally binding agreement between you (the renter) and us (the service provider).1. Acceptance of TermsBy renting equipment from us, you acknowledge and agree to comply with these Terms and Conditions. This agreement becomes binding upon the completion of the rental agreement and your confirmation of acceptance.2. Rental Agreement- Rental Period: The rental period begins upon delivery of the equipment and ends when it is returned to us in accordance with the Terms.
- Equipment Use: You agree to use the equipment only for its intended purpose and to follow all operational and safety guidelines.
- Extension of Rental Period: If you need the equipment for a longer period, you must request an extension at least 24 hours before the end of the rental period. An extension is subject to availability and approval.
3. Rental Fees and Payments- Pricing: Rental fees are based on the type of equipment, the duration of the rental, and any additional services (such as delivery, fuel, or insurance).
- Payment: Full payment is required before delivery of the equipment, unless otherwise agreed upon. Accepted payment methods include credit/debit card, bank transfer, or other methods as specified by us.
- Late Payment: If payment is not received on time, a late fee may apply, and failure to pay may result in suspension of your rental services.
4. Delivery and Return of Equipment- Delivery: We will deliver the equipment to the agreed location at the start of the rental period. You are responsible for ensuring that the delivery site is accessible for the equipment and that the necessary permits are obtained if required.
- Return: You must return the equipment by the end of the rental period. If the equipment is returned late, additional charges will be applied for each day the equipment is kept beyond the agreed period.
- Inspection: Upon return, the equipment will be inspected for damage. You are responsible for any damage beyond normal wear and tear.
5. Maintenance and Usage- Routine Maintenance: During the rental period, you are responsible for basic maintenance such as keeping the equipment fueled and lubricated, as well as keeping it clean.
- Prohibited Use: The equipment should not be used in a manner that could cause damage, including but not limited to overloading or using it in hazardous environments.
- Qualified Operators: The equipment should only be operated by individuals who are experienced, trained, and qualified to operate it safely.
6. Insurance and Liability- Insurance: Depending on the type of equipment, we may require you to purchase insurance. If you choose not to take insurance from us, you must provide proof of adequate coverage before the rental begins.
- Liability for Damage: You are responsible for any damage, loss, or theft of the equipment during the rental period, including but not limited to damage caused by improper use, accidents, or vandalism.
- Replacement Costs: In the case of irreparable damage or theft, you will be charged for the full replacement cost of the equipment.
7. Equipment AvailabilityWhile we make every effort to ensure that the equipment you request is available, we cannot guarantee availability at all times. If the requested equipment is unavailable, we will notify you as soon as possible and offer alternative options.8. Cancellation Policy- Cancellations by You: If you need to cancel your rental, you must do so at least 48 hours before the scheduled delivery. Cancellations made within 48 hours may incur a cancellation fee.
- Cancellations by Us: We reserve the right to cancel your rental agreement at any time due to unforeseen circumstances, such as equipment malfunction or weather conditions. In such cases, we will provide a full refund or offer an alternative solution.
9. Termination of AgreementWe may terminate the rental agreement if you fail to comply with these Terms. In such cases, we will require the immediate return of the equipment, and you will be responsible for any damages, fees, or losses incurred as a result of your non-compliance.10. Indemnity and LiabilityYou agree to indemnify and hold us harmless from any claims, damages, or liabilities arising out of your use of the rented equipment, including personal injury, property damage, or any other losses sustained by you or third parties.11. Governing LawThese Terms are governed by the laws of the jurisdiction in which the equipment is rented. Any disputes will be resolved under the jurisdiction of the courts in that location.12. Modifications to TermsWe reserve the right to modify or update these Terms at any time without notice. It is your responsibility to review these Terms periodically for any changes. Continued use of our rental service constitutes your acceptance of any modifications.13. Privacy and Data ProtectionWe respect your privacy and are committed to protecting your personal information. Our Privacy Policy, which is incorporated into these Terms, outlines how we collect, use, and protect your data.14. Force MajeureWe are not liable for any failure or delay in performing our obligations under these Terms due to events outside our control, including but not limited to natural disasters, war, strikes, or other unforeseeable circumstances.15.
